The old Commercial Agents and Private Inquiry Agents Act 2004 was repealed on 1 July 2022, so a licence issued under that Act is no longer the relevant authority. The New South Wales Surveillance Devices Act 2007 governs. Tracking under section 9 needs the relevant consent. Section 11 separately restricts publishing or communicating material obtained in contravention of the Act, so what happens to evidence after it is gathered matters as much as how it was gathered.
